Terms of Business & Landlord Consent
The below contains the terms and conditions of business agreed between you the client and Adam Kennedy Ltd.
By renting the property through Adam Kennedy Ltd you accept the terms set out below and in the tenancy agreement.
The landlord agrees that by completing, signing (page 3) and returning this document form they are confirming they are the legal owner of the property and are giving Adam Kennedy Ltd full authorisation to rent the property. Adam Kennedy have authority to arrange and carry out the required safety certificates and for any necessary remedial works to be completed prior to a tenant moving in. The costs of which will be deducted from the rental.
Scale of Lettings Fees – if services are required (VAT is currently set at a rate of 20%)
Standard Introduction & Management Fee: 15% + VAT (18% including VAT) of rent due
Standard Introduction & Rent Collection Fee: 12.5% + VAT (15% including VAT) of rent due
Standard Introduction of tenant: 10% + VAT (12% including VAT) of rent due
Floorplan & Professional Photographs (for advertisement purposes) £145.00 + VAT (£174.00 including VAT)
Tenancy Set-up Fee/Renewal (to carry out the right to rent & credit checks. For the preparation and issuing of the twelve month tenancy agreement. To carry out the check-in report with photographs and transfer of utility bills): £250.00 + VAT (£300.00 including VAT)
Arranging Gas Safety Inspection: £55.00 + VAT (£66.00 including VAT)
Arranging NIC EIC Electrical Inspection: £165.00
Arranging Energy Performance Certificate: £65.00 (including VAT)
Arranging Legionella Risk Assessment: £95.00
Arranging the Fitting of Smoke and Carbon Monoxide Alarms: Cost plus 10%
Arranging Rent Guarantee & Legal Expenses Insurance Cover: 4% of annual rent
12 Months Registration of Deposit/Tenancy Bond with TDS: £45.00 + VAT (£54.00 including VAT)
Issuing Section 13 Rental Increase Notice: £99.00 + VAT (£118.80 including VAT)
Arranging the Issuing of a Section 48 Change of Ownership Notice: £150.00 + VAT (£180.00 including VAT)
Arranging the issuing of a Section 21 Notice: £99.00 + VAT (£118.80 including VAT)
Arranging the issuing of a Section 8 Notice: £99.00 + VAT (£118.80 including VAT)
Arranging the issuing of a Section 3 Notice: £99.00 + VAT (£118.80 including VAT)
Arranging Third Party Property Inventory/Check In/Check Out: Cost plus 10%
Arranging Third Party Property Inspection: Cost plus 10%
Administration of Landlords Transactions for Tax Returns: £150.00 + VAT (£180.00 including VAT)
Redirection of Mail Overseas: Cost plus 10%
Duplication & testing of extra keys: Cost plus 10%
Faxes & overseas telephone calls: Cost plus 10%
Obtaining estimates and supervisor off all works including furniture – 10% of the total cost involved.

Landlord’s Obligations – Where without the consent or knowledge of Adam Kennedy Ltd, a tenancy is created between the landlord, and the tenant (originally introduced by Adam Kennedy Ltd), or anybody associated with the landlord and tenant, a fee equivalent to 10% of the gross rental will be due to Adam Kennedy Ltd from the landlord. The terms of the original agreement shall continue until the tenant, or anyone associated with, leaves the property.
The landlord agrees that by allowing Adam Kennedy to sign this agreement or the tenancy agreement on his/her behalf the landlord agrees to all the terms set out in this document and the tenancy agreement.
Payments – Account payment runs are carried out every ten working days. The Landlord is to allow 10 working days, once the tenant has made payment, for rental payments to be transferred into their relevant bank account. It is the landlord’s responsibility to inform their mortgage lender of the payment date and to pay any late penalty charges.
Legal Costs – The Landlord is responsible for taking any legal action against the tenant for rent recovery or any other matter relating to any breach of the tenancy agreement, and all associated costs and expenses.
Safety – The Landlord is responsible for making sure the property complies with all regulations. All safety certificates/inspections & risk assessments (i.e.: Gas Safe, NIC EIC, EPC, Legionella) to be carried out. The property must comply with the smoke and carbon monoxide alarm regulations.
Property Maintenance – The landlord is responsible for the cost of maintaining, up keep and all remedial & emergency works at the property.
Scale of Sales Fees (VAT is currently set at a rate of 20%)
Sole Agency: 1.5% + VAT (1.8% including VAT) – (Subject to our minimum commission fee of £3000.00 inclusive of V.A.T)
Multiple Agency: 2% + VAT (2.4% including VAT) – (Subject to our minimum commission fee of £5000.00 inclusive of V.A.T)
Where without the consent or knowledge of Adam Kennedy Ltd, a private sale is agreed between a landlord and the tenant (originally introduced by Adam Kennedy Ltd), or anybody associated with the landlord or tenant, a fee equivalent to 1.5% + VAT (1.8% including VAT) of the sale price will be due to Adam Kennedy Ltd from the landlord/seller.
If at any time the landlord decides to sell the property using the services of someone other than Adam Kennedy, a fee equivalent to 1% + VAT (1.2% including VAT) of the sale price will be due to Adam Kennedy Ltd from the landlord/seller.
